DECISION

On issuing the Regulation on Organization and Operation of

National Office in Southern Region

MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 20/2013/ND-CP dated February 26, 2013 by the Government on defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Department of Organization and Personnel,

DECIDES:

Article 1: The Regulation on Organization and Operation of National Office in Southern Region is issued enclosed with this Decision.

Article 2: This Decision is put into effect as of April 20, 2013 and replaces Decision No. 459/2004/QD-BKHCN dated April 01, 2010 by the Minister of Science and Technology on issuing the Regulation on Organization and Operation of the Representative Office in Ho Chi Minh City.

Article 3: The Director of National Office in Southern Region, Director of Department of Organization and Personnel, and leaders of related agencies are responsible for implementing this Decision.

Chapter I

FUNCTIONS, TASKS AND POWERS

Article 1. Position and Functions

National Office in Southern Region is an agency under the Ministry of Science and Technology, which assists the Minister to fulfill State management functions of S&T; monitor, consolidate the status of activities in fields under the Ministry’s State management scope and ensure facility conditions for the Ministry’s activities in provinces and cities in the Southern region.

National Office in Southern Region has its legal status, own stamp and can bank account at State Treasury and Bank to operate and have transactions as stipulated by laws. National Office in Southern Region has its head office in No. 31 Hàn Thuyên street, District 1, Ho Chi Minh City.

Article 2. Tasks and powers

1. Submitting to the Minister long-term work plans, 5-year and annual plans of National Office in Southern Region and organizing the implementation after they are issued and approved;

2. Monitoring, consolidating information and regularly on monthly basis or urgently report to the Minister the status of fields under the Ministry’s State management scope in Southern region; timely solving issues according to the delegation of authority or submitting to the Minister for solution of issues relating to the Ministry’s functions, tasks and powers as stipulated by laws;

3. Coordinating with agencies directly under the Ministry to advise and propose with the Minister guidelines, policies and measures to fulfill the Ministry’s State management functions in Southern region and providing guidelines and organizing the implementation after they are issued, approved;

4. Coordinating with agencies directly under the Ministry to organize the Ministry’s meetings, conferences, workshops, training courses in Southern region; chairing the monthly review meetings and preparing the contents for annual review meetings of the Ministry’s leaders with agencies under the Ministry which are located in the region;

 5. Being the focal point to consolidate, coordinate activities of agencies under the Minister located in region to fulfill the Ministry’s tasks in Southern region; consolidate, monitor and report to the Minister on the status of developing plans and the implementation of S&T tasks of agencies under the Ministry in Southern region;

6. Coordinating with the agencies under the Ministry to manage State-level S&T tasks implemented in the region.

7. Coordinating with relevant agencies under the Ministry, S&T organizations and enterprises in order to promote sources for S&T use and development in Southern regions; promote technology research, use, renovation, transfer and  development in Southern region as guided by the Ministry’s leaders.

8, Coordinating with the Ministry Inspectorate in inspection activities and handling complaints and denunciations relating to S&T field in Southern region.

 9. Participating in meetings, conferences, workshops organized by Ministries, branches, localities, S&T organizations and enterprises in Southern region, when being invited or delegated by the Ministry; consolidating, reporting to the Ministry results of these meetings, conferences and workshops and informing agencies under the Ministry of relevant contents.

10. Being the focal point to receive and coordinate with agencies under the Ministry, localities in the organization of short-term training, professional training on S&T in Southern areas; organizing the provision of S&T services and technology use and development services within the assigned functions and tasks;

11. Providing information and comments when there is a review for emulation titles, forms of rewards for groups and individuals in Southern region; following information and reporting systems as stipulated and guided by the Minister;

12. Ensuring logistics conditions for the Ministry’s leaders and missions in Southern region as stipulated by laws;

 13. Carrying out international cooperation activities as guided by the Minister.

14. Actively collaborating with S&T organizations and enterprises in activities of technology research, development and transfer.

15. Fulfilling mechanisms and policies for the Ministry’s retired officials and staff; carrying out receptions, compliments, visits, funerals in Southern region as guided by the Minister;

16. Managing the organization, personnel, financial resources, assets and documents of National Office in Southern Region; supporting  agencies under the Ministry located in Southern region with management of the Ministry’s fixed assets assigned for use according to current regulations;

17. Carrying out other tasks assigned by the Minister.

Chapter II

ORGANIZATIONAL STRUCTURE AND WORKING MECHANISM

Article 3. Leaders of National Office in Southern Region

Leaders of National Office in Southern Region consist of the Director and Deputy Director.

The Director of National Office in Southern Region is appointed, dismissed by the Minister of Science and Technology and responsible to the Minister for the entire organization and operations of National Office in Southern Region.

Deputy Directors of National Office in Southern Region assist the Director with National Office in Southern Region’s work, are allowed to make decisions on issues under their assigned management scopes and responsible to the Director for their assigned tasks. Vice Directors are appointed, dismissed by the Minister of Science and Technology based on the Director’s proposals.

In case the Director is absent, one Vice Director is authorized to manage and deal with National Office in Southern Region’s work on behalf of the Director.

Article 4. Organizational structure

1. The Office;
2. The Division of S&T management;
3. The Division of Accounting Affairs;
4. The Division of International Cooperation and S&T Information;
5. The Center for S&T Application and Services

The Director coordinates with the Director of Department of Organization and Personnel to stipulate specific functions, tasks and assign officials, experts working in divisions/units directly under National Office in Southern Region based on assigned functions, tasks and personnel.

The appointment, dismissal of head, deputy head levels of divisions/units directly under National Office in Southern Region follows the Ministry’s delegation of authority on personnel and as stipulated by laws.

Article 5. Working mechanism

1. Leaders of National Office in Southern Region organize its work according to a mechanism in which the leadership integrates with collective discussion.

2. National Office in Southern Region follows working regulations and relations with leaders of agencies under the Ministry according to the Ministry's working regulations and other regulations issued by the Minister.

3. National Office in Southern Region chairs and coordinate with agencies under the Ministry to agree on the contents and coordination mechanism to fulfill its assigned tasks.

4. National Office in Southern Region is responsible for closely coordinating with related agencies, organizations and individuals outside the Ministry as stipulated in the implementation of assigned functions and tasks.

IMPLEMENTATION PROVISIONS

Article 6. The enforceability validity

This Regulation is put into effect as of April 20, 2013.

The Director of National Office in Southern Region coordinates with the Director of Department of Organization and Personnel to implement this Regulation.

Article 7. The amendment and supplementation of this Regulation

The amendment and supplementation of this Regulation is carried out by the Director of National Office in Southern Region in coordination with the Director of Department of Organization and Personnel to submit to the Minister of Science and Technology for review and approval.
